Local governments normally have broad authority to regulate land uses. When a property is owned or used by a religious organization or an educational institution, however, the deference that courts normally afford such municipal regulations is greatly diminished. This webinar will provide an overview of both the federal Religious Land Use and Institutionalized Persons Act (RLUIPA) as well as New York State’s own special protections for religious and educational properties. The webinar will highlight common pitfalls local officials fall into when dealing with religious and educational land uses.
Thursday, December 18th (11:00 a.m. - Noon) Signs, Signs, Everywhere are Signs
Sign regulations are a special category of land use regulation that present unique challenges for land use practitioners because of the potential entanglements with the First Amendment. This webinar will start off with a primer on First Amendment jurisprudence before delving into an overview of legal and effective sign regulations. The session will conclude with a discussion of the importance of having well-crafted sign regulations that are administered and enforced by properly trained municipal officials.
These webinars are open to NYCOM members and non-members, including non-planning board and non-ZBA members. The cost of participating in each webinar is $20 for members and $50 for non-members. The cost for members to register for all four webinars is $65 total.
Annual Planning & Zoning Training Requirement: Note that each of these webinars will last 1 hour. If your city or village allows webinars as a valid form of training, individuals who participate in each of the four webinars will satisfy the State’s four-hour annual training requirement for planning board and ZBA members.
CLE: In addition, each of these webinars is eligible for one hour of CLE credit in the Area of Professional Practice. Attorneys wishing to obtain CLE credit for participating in these webinars MUST PRE-REGISTER. These CLE courses contain new content for 2025 and are not “repeat” courses for purposes of the NYS CLE Board's “no repeat” rule. In addition, these CLE courses are appropriate for both newly admitted and experienced attorneys and are a permissible format for newly admitted attorneys.
